These videos clearly demonstrate that this Magistrate, BAR Attorney M. Wageling, is operating routine violations of trust law.  The fact that she does so with such regularity and impunity requires some inquiry to see what the accepted procedure is in New Hampshire.  It appears as if those who oppose the redress of grievances process in the General Court stand as a boundary between the people and law.  This is simply not going to happen. 

The "mortgage" fraud occurring with this Magistrate has reached the point of null and void for her rulings.  She is part one of the fraud and felony.  The next part is the recent overthrow of the New Hampshire Constitution by the rogue faction within the House Committee on Rules.  Almost all of the Petitions under Articles 31 & 32 are against a legislative process to have the Circuit Court Family Division operate as an equity court, which does not have rules, see Family Division Rule 1.2, and many abuses of Article 73-a.  Combined abuses result in routine violations of law.  Both together are not lawful.  The existence of the framework is one aspect of the unrest.  The one in play is usually the abusive and unlawful practice of this scenario as an excuse to run government outside the law.  This is simply not allowed under constitutional law.

The videos provided by Chris King create a very unique and urgent requirement.  The Wageling crimes implicate corruption in the rules of the NHSJC.  I'm affected by the fact that the most pressing issue at hand is for those testifying for the House Committee, to re-present the audio and video content accompanied with affidavits from those present and those making statements.  These videos are indicative of crime and treason.  One cannot defend such.  This is a sign that New Hampshire is run by that which is not constitutional law.

The Democrats are damaging their credibility by siding with the courts.  That hurts their own families and constituents.  Worse yet, the Democrats have chosen to aid the side of treason.  They are throwing the Constitution out as if they are allowed.  This is not allowed.

UPDATE: Sunlight Foundation is running a story on Kelly Ayotte's well-heeled defense fund relative to my lawsuit. Unlike the Politico story by Scott Wong, look for this piece to actually explain a few things from my point of view, with the focus on Kelly Ayotte being a First Amendment hater.

I believe reporter Kathryn Lucero understood what I meant by Ayotte's crew going after me as NAACP Legal Chair a few years ago as being an abusive tool of oppression and a complete stunt because after I sat through voir dire the State mol-prossed the charges. They knew if they tried me they would lose then I could sue the living snot out of them.

Also, I am fighting against a lot of very powerful and wel-heeled Republicans because the Fund has well over $100K in it, and perhaps more than $120K so Kelly can't cry poor-pockets over this because someone else is subsidizing her defense. The $2K or so I have spent on copies and filing came out of my own goddamn pocket, you best believe that. I put my money where my mouth is.


Nashua Police beat and maced Pam Reynolds. They beat and maced Mike Gannon. They arrested and torqued on Dave Ridley and they harrassed me under threat of arrest.... all in a First Amendment context. It is unfortunate that they are not alone: On the way home I ran into a Providence area cop who was a complete jerk as well, shining his Maglite in my face and threatening to arrest me as I attempted to gather footage and stills of a rather large crash in I-95 last night. 
"Move your car or I'll arrest you," he bellowed angrily.

Really Officer? You can see I got a couple grand worth of camera in my hands and my car is OFF THE ROAD.... next time how about "Are you media?  Well be careful and do not step on the roadway or I'll have to arrest you."

But some cops just don't get it and you pick your battles wisely. With the Nashua PD I sued them and reported their conduct relative to the Kelly Ayotte campaign events to the accreditation panel. With the RI cop I simply drove up the highway and back down on the other side where he didn't notice me. Whatever the case you gotta' do what you gotta' do to get the video, the still or the interview.

KingCast sees Pelham cop Eugene Stahl clear by Kelly Ayotte successor Mike Delaney in Grant Hebert shooting, but what about the Cody Eller and Saviano cases?



Regarding the NH AG clearing Eugene Stahl and Windham's Shane Mirisola and Christopher Van Hirtum being exonerated by NH AG Mike Delaney (press release) in the 20-round shooting fest that occurred just prior to the Cody Eller trial:  The NH AG has to my knowledge NEVER found cops in the wrong, not even in the Michael Paulhus shooting when they destroyed material evidence and violated his Miranda Rights according to a judge. And not only that, Eugene Stahl is on the Laurie list for exculpatory evidence that should have been provided to Cody Eller's defense team in the Cody Eller Motorcycle Road Rage Trial that I captured on exclusive KingCast video as Eller was convicted.

Now a Motion for new trial is pending and the Court sealed the file the day after I noted that Stahl had a prior case in which his integrity was challenged in a DUI/DWI case that was thrown out in Court. I did a Lexis search on him, something all reporters should be doing.

I wrote: Saviano v. Dir., N.H. DMV, 151 N.H. 315 (2004) where there was a question as to how he advised a DUI suspect about his breath test but it was not a material issue.... if that is the basis for the Laurie list then there's not a whole lot there IMO" "....The plaintiff then took and failed three field sobriety tests. Officer Stahl then asked the plaintiff to take a preliminary breath test (PBT), advising him that "[it] was not his breath test, [and that] it was unofficial."

He informed him that it was just to prove or disprove [***5] what he had already witnessed while conducting the field sobriety tests. The plaintiff agreed to take the test. The PBT revealed a Blood Alcohol Content of 0.141, confirming Officer Stahl's suspicion that the plaintiff was driving while under the influence of alcohol. See RSA 265:82 (Supp. 2003)." "The plaintiff also argues that admitting the result of the PBT at the ALS hearing violated his due process rights. He asserts that the officer's advice regarding the PBT "would have led a reasonable person to believe that the result of the PBT would not be used against him," and that his advice was "lacking in fundamental fairness and offensive to the universal sense of fair play."

In retrospect I may have spoken too soon... one of the key issues in the Eller case is what did Stahl say to him and what did Eller respond. As a biker I welcomed the conviction, but as a lawyer and journo I cannot welcome any tainted conviction, and Eller's lawyers --- one of whom is also a biker and the other one used to be -- deserved the right to drill Stahl about his background on the stand. As a former AAG myself I find NH to be the dirtiest state in the Union, and Mike Delaney's predecessor Kelly Ayotte was the puppet so instrumental in making it that way as the videos note:

I hereby preserve my shot at SCOTUS, where the climate may be a bit different, especially with big mouth Kelly saying that Justice Kagan "is not qualified" to be a High Court Justice. Kelly isn't qualified to shine my shoes much less be a U.S. Senator, I just want what she did in the record whether I win or not she's a complete jerk. That stack of documents that I have to print -- despite being registered for electronic filing -- cost $220 and another $20 to mail. Fascinating. KingCast says: Expose Kelly Ayotte + Bad Manchester NH cops and help save a dog.



A man wrote me claiming to have damning video of Manchester, NH Police doing bad things on company (read: taxpayer) time. He sent me some stills and I spoke with him extensively on the phone. He seems credible and god knows the Manchester, NH Police Department is one scary place with its beatings of Chris Micklovich and others (need to find this one the Union Leader let it expire I will ask Copblock if they have it) and car crashes, etc. Unfortunately Michael Briggs -- one of the good ones -- was gunned down several years ago in the line of duty. 

At any rate he is seeking donations for the $3,500 surgery for his dog and is forwarding the video to me for my review. I can put people interested in touch with him as I am not directly affiliated but I most certainly am interested. The extent of my affiliation is that I will receive a limited license to post this video. Here is his email to me from October, 2012: 

Subject: video of a group of MPD breaking the law: 
Hello Mr. King I will give you my real name later on when I am sure my identity will be protected. I am writting to you because I have a video of a group of Manchester cops that I taped during a day of fireworks in front of my previous apartment on Wall Street towers, 555 Canal street, Manchester, NH. 

This is what happened: It was late in the afternoon, I was getting prepared to host a party for my friends who would come to see the fireworks every year. There was a large crowd and many people arrived early to the parking spots in front of the buinding. They would get a spot to set a bar-b-q. I had set up my video camera on the balcony and started to tape the thousands of people who made it there to enjoy the fireworks. I video recorded many people and then I noticed a group of people who looked like cops. They also gathered together to enjoy the fireworks. I would say that at least 10 cops dressed in civilian clothes and many other cops on duty would stop by and say hello to the fellow cops who seemed to have a great time. Several vehicles involved included an unmarked car and I would think that the driver was a detective or something like that. It sounded ok until now. 

When I noticed one of them taking beer out of his truck and sharing it with his fellow cops as they where arriving. He had a few coolers covered up in the back of his truck. He would look around to make sure nobody was looking and take the beer out of his truck. I also saw some of then taking a piss right next to the truck as the same guy who was providing the beer was covering them with a piece of clothing so they would not be seen pissing on the street. 

As for the cop (detective) who was in and out of the unmarked car, he was showing off with the passing by people and was lifting a pair of handcups. A group of girls impressed by the powerfull guys, decided to joint the group and at some point got inside the unmarked car.

This is to say the least. The video clearly shows many other things. I told my girlfriend that I have taped these cops and she said no to do anything because I was compromising many cops. I now live in another country and I think this tape would show the abuse of power of the MPD. I have been reading about Mr. Connare and how he got into an accident while he was driving drunk and I think this video will be a very good video to show at this time to let the citizens of Manchester know who is protecting them. 

 The video was taped about 6 years ago. I am sure the cops involved in this video, still have a position in the force. I placed the video in my friend´s safe and I just asked him to send it to me. Once I receive the tape, I will procceed to have someone erase my voice from the tape. I am sure that this video will be very usefull to you. Please let me know if you are interested on this video as I also plan to contact some people from the media. Regards,

KingCast sees folks at Twitchy and Twitter understand Kelly Ayotte is an anti-woman, anti-free press hater in the Rice/KingCast cases.

In this instance Politico is acting like mainstream press and allowing haters like Kelly Ayotte to make a run against free press that threatens the very foundations of the Fourth Estate. But it was complete nonsense, never did a gosh darn thing, heck she even ignored someone forging my name to a mortgage when I was a licensed Title Insurance Producer, how 'bout them apples, just watch the top video at about 1:44. Politico followed it, and they know she is full of dookie yet they have thus far failed to really get after her as far as her contempt for free press that has landed her in the First Circuit Court of Appeals across from Yours Truly. There are no bankster trials or convictions to report in the U.S., but there are a few in Iceland.... perhaps we need to take note and learn how to do it. I look forward to your ongoing coverage; you both asked me for updates on when I filed so you could report on the issues at hand, so I trust you both will do the right thing and report on them. Scott I hope you are now sensitized to the issue of whether a case is "frivolous" because if it is the Court does NOT tell both sides to carry their respective costs. 

The issues I am raising are complex and serious, including the issue of who paid the Nashua PD to be at the Ayotte events. Certainly I have my detractors in the Internet-O-Sphere but I will tell you this:

 John McCain is one of Kelly Ayotte's BFF's, and he likes to eject black reporters from his events for no reason as well, so I'm sure he and Kelly had a good laugh when they did it to me in Nashua at the VFW of all places.... you know, where they celebrate men and women who died fighting for freedoms we hold so dear in this Country.

So here is the Appellate brief in First Circuit Case No. 12-1891 and the four Assignments of Error are below. Meanwhile, go read this journal entry containing the Second Amended Complaint. To wit, I had an entire journal page dedicated to Kelly Ayotte just disappear about two (2) years ago. And Scribd is infamous for just making my docs disappear. Welcome to America, the land of the free.... but more importantly the home of the brave.

I. The Lower Court committed reversible error by refusing to allow Plaintiff-Appellant KingCast to file a Third Amended Complaint addressing Nashua PD’s pattern and practice of First Amendment violations and Defendant Kelly Ayotte’s Defamatory statements about Plaintiff-Appellant used to generate funds to defend this Action.


II. The Lower Court committed reversible error by applying Ashcroft v. Iqbal 129 S. Ct. 1937 (2009) and Bell Atlantic v. Twombly, 550 U.S. 544 (2007) to fact-based issues of disparate treatment where Plaintiff has a right to a Jury to determine whether his First Amendment Rights were violated, particularly at the Crowne Plaza and VFW events.

III. The Lower Court committed reversible error under Ashcroft v. Iqbal 129 S. Ct. 1937 (2009) and Bell Atlantic v. Twombly, 550 U.S. 544 (2007) by determining that there is no way possible that the events in question were public events.

KingCast presents Iqbal and Twombly lain bare to Politico's Scott Wong and Manu Raju in Kelly Ayotte First Amendment case.


This is a searing video, you bet. And the circumstances justify it. Everyone Plaintiff-side lawyer knows that Ashcroft v. Iqbal and Bell Atlantic Corp. v. Twombly are the Psylla and Chrybdis of Plaintiff/First Amendment/Civil Rights Law. Creepy counsel for Defendants and disingenuous judges who don't want to hear certain types of cases can just send you packing by saying the magic words, "Iqbal and Twombly" even with those cases don't apply to the facts at hand. Then you as a Plaintiff are left to appeal and to hammer your points home and hope for the best, which is exactly what I am doing here in my Free Press First Amendment Appeal in KingCast v. Ayotte, NH GOP and Nashua PD. They beat people involved in videotaping them. They won't dare go there with me but I'm sure some of them would love to, including Defendant Hargreaves. He's a real ass.
While I am of course arguing all portions of the case, including those in which an Iqbal/Twombly analysis could come into play, in my First Assignment of error my point is that a clear cut pattern of disparate treatment obviates any application of Iqbal and Twombly. While I may make it a separate Assignment of Error (I dunno, I wrote these a long time ago and when you revisit them you view them differently) I also argue that it was reversible error for the Court to refuse to allow me to file a Third Amended Complaint because the Nashua Police Department committed certain acts in violation of the First Amendment during the pendency of my case so there is no way I could have raised them earlier. Some of these acts indirectly referenced the First Amendment efforts of Yours Truly in exposing their antipathy toward the First Amendment vis a vis Nashua resident Mike Gannon (and Pamela Reynolds). 
It is important for Politico writers Scott Wong and Manu Raju (as well punk-assed NYC writer David Shankbone who makes a cameo in the short film) to understand what is really going on here from someone who has actually won First Amendment trials and helped shape First Amendment Law in Nashua, NH with the help of elected officials no less, as noted in this video. Writer Michael Volpe knows Kelly Ayotte is a Dirty lawyer and dirty Pol... that's why he covered the Gerard Beloin whistleblower case.

Several months ago I received an email and a call from crime writer Michael Volpe, who was then developing this story about  Gerard Beloin, a roofing contractor who is running for U.S. Congress. Writer Volpe's internet research naturally led him to Chris King's First Amendment Page because Mr. Beloin and I have been Internet friends for years. In point of fact I posted on one of Mr. Volpe's journal pages in 2008 on this issue. I have posted information (more) about some of his issues back in the day when Kelly Ayotte was targeting Mr. Beloin and trying and failing to prosecute me for fighting for Civil Rights as NAACP Legal Chair five years ago. Unfortunately for Mr. Beloin he did not fare quite as well and they were able to prosecute him on some bogus wiretap charges stemming from these tape recordings I hosted online for him so you know Kelly Ayotte hates both of us but the real question is, how did Dr. Hieber die? Dr. Not long before he died Mr. Beloin had informed him of the Goffstown High School roofing scam that needlessly cost taxpayers hundreds of thousands of dollars.

You really need to read Mr. Volpe's description of how the whole thing went down at the above "journal pages" link because it was heinous. Double Jeopardy, substantive and procedural due process violations, the whole nine yards. All of this at the same time that Kelly Ayotte was violating the Rules of Civil Procedure in her "case" against me for unauthorized practice of law that went over like a Led Zeppelin. Note that Judge Groff -- the same judge who did the right thing in cutting bail for Mr. Beloin -- found that Ayotte screwed up. Meanwhile it was Judge Diane Nicolosi -- one of the dirtiest Judges I have ever seen -- who locked him up. Nicolosi is prone to letting banks get whatever they want, even when hearsay is evidence and standing to foreclose is not proved:
 
Be that as it may Michael Bahan as an investigator is a joke; the only thing scarier than that is knowing that my nemesis Judge Paul Barbadoro represented Judge John C. Fairbanks, one of the biggest scumbag Judges the World has ever seen. That's why he died a lonely death in a Las Vegas room with a bag over his head. As for Bahan he's prone to disappearing too. KingCast and Judge Arthur Schack put a stake through IndyMac and Fein, Such & Kahn's hearts in IndyMac v. Meisels, 2012 NY Slip Op 51902.


  
Well it was an unpublished Decision, until it hit the Internet that is LOL.... Can you imagine that, foreclosing in the name of an entity that didn't exist at the magic moment? Well sadly it is nothing new and as I note, Judge Paul Barbadoro let a Linda Green robo-signature and a post hoc Sand Canyon assignment stand in a New Hampshire Fraudclosure case. At least one of his brethren saw differently on the exact same issue in another case, Drouin v. Option One NH Dist. 11-CV-596. But as far as that stake goes, His Honor's analogy was so apropos.... and to that stake up front I will add a size 10 John Varvatos boot to the can and break them both off. Then throw them in a shallow grave and spit on it. Sadly President Obama and challenger Mitt Romney sidestep the meat of the issue. As noted in today's feature presentation it is law firms like Phelan, Hallinan & Schmieg and Fein, Such & Kahn that are ruining this Country, along with the Judges who allow them to run amok. Well they might own a lot of the judges but they don't own the internet and they certainly don't own me.
