Here is the Mark Meckler case, and here is the Federal Statute that arguably governs this matter, allowing him to transport his weapon in New York. Mr. Meckler's lawyer is one Brian Stapleton, a very bright and dedicated attorney I've known since undergrad in 1984. Both of us are Case Western Reserve Law graduates.

Greg Floyd was a known risk to Law Enforcement, including then-NH AG cum U.S. Senator Kelly Ayotte, who covered it all up and cleared this multiple felon for the murder of Liko Kenney in 24 hours. He then went out and criminally threatened his frail, elderly female neighbor with a gun. Arresting LE and I are pretty cool, and one of them told me "Greg Floyd is a racist whack job, and he will kill again."

If the Feds had taken steps to charge him under 18 U.S.C. 922(g)(1) 12 years ago when the Grafton County Court asked them for intervention (docs coming) we might not have this problem. But the Feds passed -- the Grafton County Superior Court Docket Sheet on Case No. 98-S-242 clearly reflects that the U.S. Attorney's office failed to respond to the same inquiry made ten (10) years ago. They again passed on charging him in 2009 when he turned in yet another weapon. The Statute is 5 years guys, as a former State AAG I respectfully ask that you take action before Hollywood shows you up.

Here is what Kelly Ayotte hid about Greg Floyd, and here is his rap sheet. Moreover, I know that in the following Affidavit (scrubbed from the Internet I will have to repost it) Greg Floyd threatened a school admin with "Mind your business.... I know where you live and the route you take home, and if you're not careful they will take you home in a body bag."

Makes you wonder if he knew the route Liko Kenney took home as well.

Here's this weekend's NYTimes story. In sum,

The study has two parts. One used data from actual bankruptcy cases from the Consumer Bankruptcy Project, the most detailed trove of information on filers currently available. The project surveyed 2,400 households nationwide who filed for bankruptcy in 2007.

Results from the second part of the study, which illustrated the lawyer’s influence in determining which bankruptcy chapter to choose, came from a survey sent to lawyers asking them questions based on fictitious couples who were seeking bankruptcy protection. When the couple was named “Reggie and Latisha,” who attended an African Methodist Episcopal Church — as opposed to a white couple, “Todd and Allison,” who were members of a United Methodist Church — the lawyers were more likely to recommend a Chapter 13, even though the two couples’ financial circumstances were identical.

Sadly, there's nothing new here. Racial discrimination in housing was going on since the Warsaw Ghettos in the Old World and on into the hills of Cleveland Heights where we were one of exactly three (3) black families for miles and miles back in 1970. That was related to the landmark case of Heights Community Congress v. Hilltop Realty 774 F.2d 135 (1985), as noted in $335M Bank of America racial settlement journal entry. You gotta bring up all the McCafferty recusals you see on my blog and demand to know specifically why they were occasioned -- including mine, that will really toss a monkey wrench into the mix.

You gotta explain that nothing is strategic and write an Affidavit that you only recently found out about the connections after due diligence and that August to December is hardly a long time.

You gotta say that the ongoing pattern and spectre of sexual abuse and ongoing coverup is what is paramount here when they try to narrow it.

The bottom line is that there is indeed a potential financial impact to the McCafferty family if the Diocese goes down in this case, and they try to dance around it but it is unavoidable..... and Judge Joseph LaPlante's association seems a tad cozy too, what with using his U.S. Courts email address for contact ....

Somehow in today's story not one but two seasoned journos Louise Story and Gretchen Morgenson of the NYTimes missed the Bill Clinton issue and the outright fabrication of the child cancer victims to report only the alleged and more minor pirate issues against George Carlin (RIP). Not only that but the entire tone of the story was more like softball city than knock out punch, as it implied that Bank of America picked up Countrywide out of some sense of integrity when in point of fact many are saying that BoA is just as bad, if not worse then Countrywide. All I can tell you is that we are going to get to the nitty gritty with these fools. We are about to start putting up certified cashier's checks to BoA on Presentment and demanding the original note and mortgage hahahahaa...... and when it doesn't appear we have title companies at the ready to convey the property to the rightful owner, you stinking liars.

Details and links later but of course you remember how Judge Paul Barbadoro was so obdurate in telling me "Plaintiff's Motion is absolutely without merit" in the Free Press litigation against Senator Kelly Ayotte, KingCast v. Ayotte, NH GOP and Nashua PD NH Dist 2010-CV-501, watch the courthouse video. This despite the fact that she worked for McLane, Graf -- my opposing counsel Jack Middleton and NH Bar Association President Jennifer Parent were Ayotte's superiors. The links below and the movie above show how Magistrate Landya B. McCafferty slinked out of the case with a back door recusal that was only properly filed after I complained about the ECF notation. To this day the none of the NH District Judges have explained their recusals, although I know that LaPlante has a legitimate reason because of relatives' campaign contributions. In the case below it is because of his affiliation with the Catholic Lawyers Guild as Director.

Now it appears that Magistrate Judge Landya B. McCafferty's husband Patrick McCafferty as employee of St. Thomas Aquinas High School has direct connections with the area Diocese involved in the case of Mary and Thomas Ryan v. Robert T. Krause, 111-CV-00037, all stemming from years of sexual abuse and lies and coverup, some of which I have documented here in another context involving RSA 641:3 lies told by Kelly Ayotte's "hero" Gregory Floyd, whom I believe murdered Liko Kenny. Ryan opted out of a forced settlement and REALLY made some folks very angry. Meanwhile Magistrate McCafferty is of course issuing adverse rulings in the case that I will pull from Pacer later today. I know there is a pending Motion for Recusal against McCafferty and Judge Joseph LaPlante, whom I believe currently is involved with entities like the Catholic Lawyers' Guild, which arguably puts the Bishop of the Manchester Diocese ahead of American Law. But don't ask me, read it for yourself, above.

Phone call today to verify the association and identity and check up on the case law for spouses, but even before I do that I can say it is indeed questionable. McCafferty of course was an Ethics advisor with the NH Bar/Discipline folks. St. Thomas would be far from ecstatic. But what do I know, right. Perhaps Senator Leahy's Office knows better, or at least they know what I know.... perhaps you should ask them because they sure are interested:

10:25a update: phone to school, HR is out this week. Admin is waiting to hear from the Principal, she asked me the reason for the inquiry and verified connection between Diocese and the school, I telephoned the Courthouse and left a message with clerk Jim.

Brown University/Marcella Dresdale lawsuit over alleged bogus rape settled quietly out of Federal Court.

It does not include the false rape allegations that Brown apparently conjured up, at least to my reading. Here is my first story on it, in para. 2, relating to cases that move forth and back between NH and RI District Courts, such as my Kelly Ayotte/GOP/Nashua PD free press lawsuit that traveled to RI after I busted Landya B. McCafferty for not telling me she worked for McLane Graf. McLane, Graf is the former law firm of Defendant Kelly Ayotte and my opposing counsel Jennifer Parent and Jack Middleton, as if they didn't know better for not telling me that. Parent is NH Bar President for Pete's sake. Now what puzzles me is why the Businessweek writer and editor mischaracterized the settlement as the case being "dropped." That ain't what happened folks, take it from a former Federal litigator, that case was not "dropped" but rather dismissed as part of a settlement, as Plaintiff's lawyer clearly noted within the body of the story. In this journal entry I showed how State Rep Timothy B. Comerford got involved so that Marie Miller apparently prevailed in her case, only to subsequently find that they reopened the case that was allegedly dismissed by NationStar. Ms. Miller asked that the Withdrawal be clarified as to whether it was with or without prejudice, a reasonable question. The Court then stated that her request reopened the case, but the question remains why there is a case in the first place given that NationStar should squarely be held in contempt for its failure to produce the original mortgage and wet ink note, when the failure to provide such items properly results in dismissal, except in New Hampshire as we see with Judge Diane Nicolosi and foreclosure mill attorney Shawn Masterson. But see how it is really supposed to work as you review NY State Judge Arthur Schack, AZ Bankruptcy Judge Eileen Hollowell and Judge Christopher Boyko from my former Federal practice venue when I was AAG and in private practice, prior to becoming a title insurance producer.

Don't forget to watch Mike Gannon's FBI and Nashua PD movie in which he demands his discovery. He called me today they told him he could pick up copies and charged him $25!!! Let's see what he gets. Anyway the FBI intake personnel took copious notes, and I explained.... Look... this is not a case where some jerk gets in the officer's way and unbalances a situation during exigent circumstances.... if that were the case I wouldn't be here...... And yes again to the FBI only the notepad and external office pictures were taken, rest easy. A reporter has to know his or her limits.... and so too must the Nashua PD.

Regarding the complaints, we know not to bother Senator Kelly Ayotte because if she had her druthers we would all be arrested, detained and silenced without warrant. Now I know you are busy, I've been a government lawyer myself and things get hectic. Note: They tried to bring in Jack Middleton for the whammy at the end of the 4-on-1 session and he says "Your Honor he can't just say he didn't get his way because he's black." Newsflash Jack, did you happen to notice that about 90% of my support base in Court today was white? And they think race has a part in it as well. Note: I reminded the Court that I should have been able to file my Third Amended Complaint for actions Defendant Ayotte and Nashua PD committed after I filed my Second Amended Complaint. My case has only been around one (1) year but His Honor allowed an Amendment after two (2) years in TG Plastics v. Toray Plastics, 2011 U.S. Dist. Lexis 81122.

Note: Judge John J. McConnell took the matter under advisement and will issue an Order, I would guess prior to the New Year. He is the visiting Judge from RI after I scared all the NH Judges into recusal..... but I guess I'm not entitled to know why they all scurried so even though I only moved to recuse Magistrate Judge McCafferty, a Motion to which former sitting Judge Paul Barbadoro initially held was "entirely without merit." Right.

I quoted Justice Rehnquist who noted that allowing black reporters to attend the publicly-advertised KKK rallies in NAACP v. Thompson does not amount to a Fifth Amendment Constitutional taking, as the Defense Counsel almost fooled the Court into believing, before I took the microphone. Read it right here at 648 F. Supp 195 (1986).

In Pruneyard Justice Rehnquist further wrote:

It is true that one of the essential sticks in the bundle of property rights is the right to exclude others.Kaiser Aetna v. Brian Cullen, Nashua Defense Attorney in my case, had exculpatory EMT report that proved Mr. Holder never assaulted his daughter but he refuses to say when he obtained the report or who provided it to him. Kelly Ayotte's pal and Veteran's Chair Stephen Monier -- who threatened to call the police on me as I stood on a public sidewalk -- even characterized Mr. Holder as a dangerous fugitive from Justice. That prompted Mr. Holder to issue a Cease and Desist letter (seen in my Objections to Magistrate McCafferty's Report and Recommendations before I made her recuse herself because she worked at Ayotte's law firm with my opposing counsel) shortly before Monier resigned as U.S. Marshal. This is his comment:

"The Constitution cannot control such prejudice, but neither can it tolerate it. Private biases may be outside the reach of the law, but the law cannot, directly or indirectly, give them effect." That's a quote from Palmore v. Sidoti. a child custody case, but nonetheless, the principle remains across the board when it comes to the conduct of public officials as is the below.

"Public officials sworn to uphold the Constitution may not avoid a constitutional duty bowing to the hypothetical effects of private racial prejudice that they assume to be both widely and deeply held." Palmer v. Thompson,

Writes Holder: You made an excellent point that in one instance you were actually invited to appear. Given my law enforcement experience, I believe the police had more than a cursory responsibility to determine exactly why you were be asked to vacate public or commercial property , as opposed to private premises, for trespass. They owed you a duty to determine why? They gave the force of law to someone's private biases and prejudices.

Deets later, I need a nap. I will say this much: Sushi lunch revealed many salient observations about what the onlookers saw as I mentioned certain items, people and issues. So here's what happened, in a nutshell: I reminded the Court that "hey racists don't call me nigger anymore Your Honor" but that they have other ways to use race as proxy for ideology to separate me as a journo as opposed to all of the white journo. I noted that this case does not occur in a vacuum, and that these are not truly private events because you have a former AG running for U.S. Senate, along with paid advertising to the General Public. Let me tell you what these events are not: These are not GOP strategy sessions. These are not Communion afterparties. Nor is it my GF's son's Bar Mitzvah. At those kinds of events of course you can pick and choose to throw any media you want to out if they show up. But given this context in a National election to an election that is exceeded in importance only by the Presidential Election, the Court is free to say that the Bright Line Standard allegedly sought by Nashua PD Counsel Brian Cullen lies somewhere south of the Grand Ballroom at the Crowne Plaza, but north of Kelly Ayotte's personal home given these publicly-advertised events.

In voluntarily dismissing my public accommodations claim (I didn't file administratively) for when Nashua PD continued to harass me after I had left the leased GOP/Joe Arpaio area the the Crowne Plaza I told the Court: "The larger issue is the fact that they continue to bother me at Crowne and at the VFW John McCain rally even though I was following their instructions. At that point you have to leave me alone, let me do my job and just shut up.... and every time they bothered me Your Honor they were trammeling my First Amendment Rights as a journalist to gather news and to write my story."

And I know more than a bit about unlawful use of Police authority both as a former AAG and in private practice, in Isreal v. Roades and Hensley I got those LE busted for making my client a victim of violent crime, V96-61481.

And I reminded the Court that the rationale for not allowing me into the Joe Arpaio "steak out" public invite rally shifted, and shifting rationale is but one way to show that the proferred legitimate nondiscriminatory rationale is pretext for racism. First I was allowed in explicitly as a journo by Defendant Di Lothrop and Defendant Dennis Hogan, Nashua Republican Committee Chair who is also County Attorney. He knows me well. Then Defendant Ryan Williams informs me that I am not a journalist then Di Lothrop does a 180 and says "you are not a member of the media" and THEN she says "this is a private event."

I says they are full of it. Watch the movie, it doesn't lie. But they do every time they open their mouths.

Also I noted that an RSVP to the VFW John McCain/Kelly Ayotte and my acceptance constitutes thereof constitutes a contract pursuant to 42 U.S.C. §1981 (which must be applied and construed liberally as a remedial Civil Rights Act) and that it is impossible for me to have more proof of racial animus on than what I have at this point because I have not yet had any discovery. For all I know the Republican policy on indie media is to let all of us in. Now if they are breaking with policy the trier of fact could find racial animus. Also Kelly Ayotte's past actions toward me as an AG might not be actionable under prosecutorial misconduct rubrics but they can still be probative of racial animus, particularly when coupled with the fact that she now continues to lie to me and to avoid doing anything about the forgery of my name to a mortgage even though she says in video that she would do something. I reminded the Court that Kelly Ayotte and her Chief of Staff John Easton lied in collecting public money to defend this litigation by stating that I had filed frivolous lawsuits, which is actionable in and of itself.

I reminded the Court that Nashua PD blew it on application of Trespass laws against indie journo Dave Ridley and private citizen Mike Gannon in light of Glik v. Boston.

Addendum: On further review, these are some precious photographs. Wait until you hear what folks are saying in the video. The Big Dog lawyers, including NH Bar Association President Jennifer Parent, all scooted out the side door, I figured as much and they made their front door sortie on Dave Ridley video already anyway, as noted in a link I will soon post.

Also, Ridley is pissing me off... he now says my material is so dense he doesn't understand it, and will not be attending my hearing, but he certainly understood it a few months ago as noted in his own video. And his lawyer Seth Hipple, I could damn near feel ice in his veins when I asked him for a copy of Ridley's acquittal/NG Verdict. I dont' think he even gave it to me, I think I had to get it at the courthouse, whatever dude. Anyway I'll tell you why later, but I've mentioned it in a prior post. Either come correct DR or don't come at all, I have no time for any half-stepping bro. She had pleaded guilty to falsely notarizing Trafford's signature, affixing her official stamp to his signature even though he wasn't present. Lawrence was due to be sentenced Monday on the single count, and the attorney general's office had agreed to support her lawyer's request for probation. But Lawrence failed to appear in court for the sentencing. The attorney general's office called the police, who went to Lawrence's apartment and discovered the body, Las Vegas Police Sergeant Matthew Sanford confirmed.

Sanford said in a phone interview that the death "currently is not being investigated as a homicide." He said the cause of death likely won't be known until completion of toxicology tests by the country coroner, which would take several weeks.

Neocon U.S. Senator Kelly Ayotte, fresh off a scary detention initiative on her attempts to detain (and likely torture) Americans without hearing, is now set to explain how she can invite members of the public and press to Senate campaign events, then pick and choose which ones can stay, a la John McCain and Stephen Price. The ACLU was rightfully cringing, and former LE and current U.S. Passport Inspector Ralph Holder today initiated a Kelly Ayotte Recall Petition. Funny, but when I was NAACP Legal Chair in Ayotte's NH my very first post in 2005 was on the Patriot Act. She can't stand me or my cameras or my affinity for exposing her lies, some of which are soon to appear on the Big Screen relative to the double homicide Bruce McKay, Liko Kenney Greg Floyd Franconia shooting tragedy. Kelly Ayotte graduated from Villanova, which is certainly no slouch school, it just occupies a space a bit lower on the food chain than Case Western Reserve, which is the alma mater of Judge John J. But in Kelly Ayotte, Villanova certainly graduated an open government and free press hater.... and to me, that's just plain stupid and Unconstitutional. Anyway they are right: There is nothing wrong with making money... it's all about how you go about doing it that is the question, and Senator Kelly Ayotte is all about protecting the interests of corrupt bankers and lawyers who forge documents and engage in robo-signing like these tools over in New Jersey, watch the video at Mortgage Movies Journal.

Not only that, Kelly Ayotte and Mitt Romney both have open contempt for the Free Press, he had a fake cop threaten a reporter and Kelly Ayotte gave Bad Cop Fred Hoysradt a pass after he SEXUALLY ASSAULTED reporter Elizabeth Dinan. And Norman Bruce McKay -- her favorite cop who can't even get a roadway named after him in his death -- chased his woman into a safe house right around the time she was giving birth to their only child, yessir do the math. And she totally covered up the tragic shooting in Franconia that is the subject of this Dorothy Aufiero/Casey Sherman screen adaptation of "Freedom and Death in the White Mountains". And of course the Union Leader has endorsed this dirtbag, which is par for the course with these yellow journalists.... remember the scathing editorial (seen at the middle of this page) they put up on me as NAACP Legal Chair and then were forced to eat crow and take it down as I prevailed on the criminal and civil cases and Senator (then AG) Kelly Ayotte and former Jaffrey Police Chief Martin Dunn ended up looking stupid.

Others have tried to hide from KingCast cameras before and I figured it out, i.e. Nashua GOP's Karen Thoman, who slapped my camera with a GOP flier as she stood there cloaked in wannabe elitist white skin privilege as Nashua PD looked on and did nothing, then ran me out of the entire Crowne Plaza, chilling my First Amendment Rights as a reporter. It is simply disgusting and repugnant to the purported ideals of the Free Society in which we live. Also Senator Ayotte's Chief of Staff John Easton is a lying scumbucket as well, he claimed that I have filed "frivolous lawsuits" against Kelly Ayotte when in point of fact there is no proof of that, yet there is proof that she instigated bogus and failed civil and criminal litigation against me, so these people can basically go to hell.

Lindsey Graham (R-S.C.) explained that the bill will “basically say in law for the first time that the homeland is part of the battlefield” and people can be imprisoned without charge or trial “American citizen or not.” Another supporter, Sen. Kelly Ayotte (R-N.H.) also declared that the bill is needed because “America is part of the battlefield.”
Meanwhile keep in mind that she and the other Defendants think it entirely permissible to publicly invite the general public and media to campaign events with Joe Arpaio and Senator John McCain (who loves to eject black reporters from events, BTW), then threaten to arrest the reporters they don't like. It's almost funny.... when I was a practicing attorney I never shied away from anyone because I had conviction in what I was doing. Ask Jerry Doyle's (RIP) family about that. Most foreclosure mill attorneys never have a visual website presence and that is because deep down inside they know they are doing the Devil's Work. HuffPost writer Allison Kilkenny and I were next to each other and we were both very impressed. They've got legal, media, electronic, tactical and all matter of committees working together. They count the hundreds of unoccupied buildings in the City and highlight the fact that the homeless shelters that were full 25 years ago are now twice as full. Their chant is real: "Oh-Four-Oh is ready to act... we see you... and we got your back!"

Also, I hear the Baum Law Firm is engaged in massive layoffs, let's hope they completely fail and that some of their snooty, self-righteous staff wind up upside down in their McMortgages and totally homeless, ahem.

I have a huge Federal hearing on this free press lawsuit 5 Dec. 2011 on KingCast v. Ayotte, NH GOP and Nashua PD. They threatened to arrest me at events that were publicly advertised and open to the general media.... except yours truly. Read up. Also her Chief of Staff John Easton is a jive turkey who lied about me as he sought congressional funds to defend the case.

But then again Kelly Ayotte didn't even care that someone forged my name to a mortgage and she allowed the largest consumer scan in NH history to go down on her watch, the FRM Ponzi scam. She's horrible. Watch her response to a little old lady on the Occupy Wall Street movement.

The Soup Dragons - I'm Free (feat Junior Reid) by 80Srules

Ahhh.... the Soupdragons and Junior Reid, a classic. I'm free to be who I choose.... any old time.... Anyway, that email is relative to my ongoing request for a simple investigation into the forgery of my name to a mortgage and the use of U.S. telephone lines to obtain money using said forged signature. As to my complaint, Kelly Ayotte couldn't get it done as AG in 2003 nor has she been able to bust a grape as a U.S. Senator. Yet we are somehow inherently supposed to put our trust in her to address serious national and international monetary and Civil Rights issues? Yah, right. This chicka is one bought-and-sold big money honey that's for certain.
